Terms and conditions

These conditions govern the relationship between PASEO LAB, SOCIEDAD LIMITADA ("the platform") and the people who use its services: creators who build routes, and users who buy and walk them. Using any of these services means accepting them.

These conditions are the contract between the platform and its creators, who accept them when they register. For someone buying a route, they describe how the sale is arranged and who is responsible for what: the purchase itself is governed by Apple's terms, as explained in sections 2 and 3.

Full identification of the platform is given in the legal notice. Processing of personal data is described in the privacy policy. Both documents form part of these conditions.

The platform is a marketplace for digital content. The itinerary and the texts of each route are written by a person — its creator — not by the platform. What the platform provides is the infrastructure: review before publication, narration by a synthetic voice, generation of the illustrations, automatic translation into the service languages, distribution through the App Store and settlement of the creator's earnings.

Routes are sold only through App Store in-app purchases. For buyers in Spain and the rest of the European Economic Area the seller — the merchant of record — is Apple Distribution International Ltd., under the Apple Media Services Terms and Conditions: the contract of sale is between the buyer and Apple. PASEO LAB, SOCIEDAD LIMITADA supplies the content and is responsible for it; the creator is the author of the itinerary and the story and keeps ownership of it. In some territories outside the European Economic Area Apple acts as an agent and the seller is PASEO LAB, SOCIEDAD LIMITADA.

The platform does not organise guided tours, does not provide in-person tourism services and does not accompany users along the route.

• Where you buy. Only inside the iPhone app, through App Store in-app purchases. Nothing is sold on this website.
• What you buy. The itinerary and the story written by the creator, together with the narration, the illustrations and the translations the platform generates from them. The box below sets out how each of those is produced.
• One language means one language. Each purchase gives access to the route in the language chosen at the time of purchase. That language cannot be changed afterwards; buying the same route in another language is a separate purchase.
• Download and offline use. After purchase the route is downloaded to the device in full — texts, points and images — and works without an internet connection.
• Price and taxes. The final amount, including the taxes applicable in the buyer's territory, is shown by the App Store before confirming.
• Routes taken off sale. If a route stops being sold, anyone who already bought it keeps access and can download it again.

How a route is made. The itinerary and the story are written by a person. The narration is read by a computer-generated synthetic voice: no recording comes from a human voice. The illustrations are generated by artificial intelligence. Every language other than the one the creator wrote in is machine translation. The narration, the illustrations and the translations may contain errors, inaccuracies or unnatural phrasing, and the content may become out of date.

The right of withdrawal for digital content, and its exceptions, belong to the relationship between the buyer and Apple, are governed by the Apple Media Services Terms and Conditions and are given to Apple. The platform neither collects nor administers that consent.

Refund requests go to Apple at reportaproblem.apple.com. Apple decides them under its own policies; these conditions neither bind Apple nor limit its decision. Complaints about the content of a route go to the platform at support@caminata.app.

Routes are walked outdoors, on public streets. Users walk at their own risk: pay attention to traffic, follow signage and local rules, and do not look at the phone while crossing. The app is no substitute for your own attention.

Route content is informational and may become out of date: shops close, streets are dug up and places change. Children should walk routes accompanied by an adult.

The account is opened with a Google account and is intended for adults, since it involves entering into a contract and receiving income. The information provided must be accurate and kept up to date. Creators are responsible for activity carried out from their account.

Creators keep ownership of what they write. By submitting a route for review, the creator grants the platform a non-exclusive, worldwide, royalty-free licence to translate it into the service languages, generate the illustrations that accompany it, distribute it through the app, and use its title, description and illustration to promote the service itself. In respect of copies already purchased, the licence continues for as long as there are users who bought them.

Creators warrant that their content is original, that it infringes no third-party rights and that it includes no other people's personal data without grounds. Creators do not upload images: all illustrations are generated by the platform.

• No unlawful, offensive or discriminatory content, and nothing that puts the walker at risk.
• No itineraries leading onto private property without public access, or to dangerous or restricted places.
• No content copied from other guides, books or websites.

No route is published without prior review. The platform may approve a route, reject it — always with a stated reason, visible to the creator in the panel — or, once published, take it off sale or return it to draft for correction. Returning a published route to draft is only possible while it has not been sold in more than one language.

When a route returns to draft, the translations and illustrations derived from it are deleted; what its author wrote is kept.

• Apple's commission. Apple withholds its commission on each purchase under App Store terms, before remitting the amount to the platform.
• Platform commission. The base is the net amount the platform receives for the sale: the price paid by the buyer, less the taxes of the buyer's territory and Apple's commission, as calculated and reported by Apple. Of that amount the platform retains 35% as a service commission and credits 65% to the creator.
• When earnings are credited. Earnings appear in the panel once the Apple daily sales report covering that sale has been processed, normally one or two days after the purchase.
• When earnings can be withdrawn. Credited earnings become available once the platform has actually received from Apple the money for the settlement period they belong to, which normally takes about a month. The panel shows the two figures separately — what has been credited and what is available. Withdrawal is initiated by the creator and requires an available balance of at least €50.
• How payment is made. Through Stripe Connect. To be paid, the creator must complete the identity verification Stripe requires under anti-money-laundering rules.
• Taxes. Each creator is responsible for declaring and paying tax on their income under the law of their country of residence.
• Refunds. If a purchase is refunded before the platform has been paid for the settlement period it belongs to, the amount is deducted from the creator's balance. If it is refunded after that, the platform bears it: the creator's balance is never taken below zero.

The platform may suspend an account that breaches these conditions, stating the reason. Creators may delete their account at any time from their settings, provided no withdrawal is in progress.

Deletion is final and has two effects worth knowing before requesting it. First: routes already published or archived are not deleted — they are reassigned to the platform's administrator account so that the people who bought them keep access — and with them the right to any future earnings they generate is lost. Second: the email address used is permanently disabled and cannot be used to open a new account.

The platform is answerable for the operation of the service it provides, but does not guarantee uninterrupted availability or freedom from errors. It is not answerable for content produced by creators beyond the review described above, nor for harm arising from how a user walks a route in public.

Nothing in these conditions excludes or limits liability that cannot lawfully be excluded or limited, in particular towards consumers.

These conditions may be amended. Substantial changes are communicated by email to registered creators, and the date at the top of the document changes with them.

Spanish law applies. Complaints may be addressed to support@caminata.app. Where the user is a consumer, the courts of the user's place of residence have jurisdiction.
